fedex/kinkos lost my vest

I lived in hawaii with my husband who is in the marines. He is leaving for japan so i decided to go home and stay with family till he got back. So i have the hill-rom 103 the old version so its a pretty big machine. My hubby and i took it to fedex/kinkos in honolulu and shipped it out. We bought a box from them and it was huge... so i also had a box of clothes (which we stuck inside the big box with my vest) So they helped us pack up the box...We totally forgot to put insurance on it which i know was a big mistake!!! So now i am in vancouver wa with my family and my mom says heres your box... so we open it up to get the vest out so i can do a treatment and what they shipped me was somebody elses comercial bun toaster... I just wanted to cry... So the kinkos place had stuck my sticker on somebody elses box and stuck somebody elses sticker on my big box... So now i am left withouot a vest... My doctor is still working on geting me my new vest so nwo i am left without one... So i guess on the hawaii end the kinkos place is giving up on trying to find my box. and they sent me to collections dept. the bad thing is that i didnt put insurance on it, but the guy saw what it was and i told him it was expensive.. So now i am waiting for fed ex to call me back cause they are doing an envestigation on where the box could have gone. SO i guess i will have to go back to hawaii to take kinkos/fed ex to court... actually we are just takeing the kinkos part to court cause it was all their fault, we recieved a box so its not fed ex's fault. The guy that helped us put the wrong stickers on. So i think that i have a case what do you guys think? And for everyday that i dont have a vest i get sicker... my lungs are junkin up... i havent had a vest treatment in like close to a month now!! so i am gonna try to sue the crap out of these guys cause it was just a stupid error that could have not happened if the person was paying attention to his job. So i think i am going to have my hubby go to the military gag office to see where they think we stand with this case...I dont know what else to do, i am so furious, i need a treatment!!! ok sorry for my venting i just wanted to let you know dont use kinkos fed ex!!! haha!!

I can tell you right now a Jag officer can't do crap for you. I do think you have a case though. Unless you want to hire a lawyer, you'll have to take them to Small claims court. Do you know what the maximum award in small claims court in HI is? I'll try to look into it for you if you don't know.

Where are you staying now?

Did you write an inventory page at all for what was included in the box? Do you have renters insurance? It's worth it to ask and see if they might offer some coverage.

I really think that Tricare will authorize coverage for a new vest, I really do. but I would also Sue kinkos/fedex if I were you too.

<b>Call Hill-Rom right away!!! See if they will get you a vest </b>-- they usually care more about getting a vest back in the house than making sure it will be covered by insurance, at least you have the machine and are not skipping treatments.

To sue or not to sue -- will take a lot of time ~ I think the <b>priority</b> is to get you another vest ASAP -- figure out how to accomplish that task first, then worry about how & who to sue.

Also -- Julie -- I'm not 100% but usually small claims court is under $1000. (I think -- I could be totally wrong about that)

The max in Hawaii is $3,500 in small claims. You could take them to civil court and represent yourself, or get a lawyer (the latter of which would be very costly!) but if you represent yourself it's risky because they are a big organization and will have a lawyer representing them. So it's you against someone who is versed in law.....

I agree with Alyssa though, I didn't even think about it but contact hillrom, tell them what happened and see if they can help you!

Alyssa, the maximums for Small claims vary from state to state. In WA the maximum is $4000 and In CA it just went up to $7500. YIKEs!!!!

Contact the CF center in Portland (I went there for years!) And see if they have vest that they can loan to you until you get a new one. Or if nothing else maybe you can stop into the respiratory therapy department there and get a treatment a couple times a week. And sue kinkos for all they've got!

Hey Julie thanks for the update -- maybe I was living in the past :) I kind of thought to myself as I typed that, that $1000 isn't much anymore, so $4000 sounds more reasonable.

And I had another thought about getting a vest in the mean time (hoping that your old one will turn up) ask about getting a rental from Hill-Rom or any of the other companies.

I would second what Jessi said. Or even have your husband or a family member beat on you until you get your vest situation is settled.
Sorry this has been such a bad ordeal.

I am just letting everyone know that after a month of crap trying to find my vest they might have found it!!!! yeah... keep your fingers crossed that it is the right package! Oh man do i need a good treatment~!

Shouldn't there be some family out there with a vest who is wondering what happened to their toaster? Has anybody tried asking FedEx to pull a list of all the packages they picked up from Kinkos on that date and looking for one that was way too heavy to be a toaster then see where it went...
