Hi All!

So, my boyfriend, with CF, was laid off yesterday (along with 20 other employees, but he was the only one to go from his department). He worked for this company for 7 1/2 years!

Does anyone have any thoughts on any legal actions he might be able to take since he's a protected class? We are both very new to this kind of a situation and don't really know what to do. He thought about going on disability before and is definitely now actively looking into it (thanks, again, for all of your advice on disability - we'll be using all of it very soon!).
I'm a little worried about how much Cobra insurance will cost him and if we are going to run into any financial trouble b/c of all of this.

Anyway, I just thought I'd throw the topic out there and see if anyone had any thoughts or advice.

I'm pretty sure that the ADA only protects a person with CF against being wrongfully terminated. If other employees were let go as well, it's doubtful there's a strong legal case. The ADA does NOT guarantee a person with CF the right to continued employment no matter what. This is something I have learned, as I am currently on leave from my job.

You may want to call the cystic fibrosis legal hotline, and see if they have info for you. CF Legal Hotline (800) 622-0385 CFLegal@cff.org. I know for certain that they'll have some info about how to handle COBRA, Medicare Prescription Programs and the like. Unfortunately, I don't think there's much legally that can be done in terms of being reinstated to his prior position with the company.

I hope he'll be able to be approved for SSI or SSDI without too much trouble. Remember, he has to be able to prove his health is such that he's unable to work. I'm not sure which state you're in, but if you go to your state's website, you might be able to find some info.

This is a bit tangential, but I wanted to mention it just because it's one of those "responsible things" adults should keep in mind. You mentioned you hope "we" don't have financial trouble. Please be careful not to intertwine your finances too closely, since you're not married. In the event that things don't work out, it would be a shame for you to have a ruined credit record on top of things.

I agree with Lauren. If it was just him then I would believe you might be able to pull a case together. I believe they call it "downsizing".

If he was "laid off" and not terminated - he will get unemploment right? and is there any chance of being called back? Usually you get unemployment (a percentage of your pay) and just have to send out applications for employment to show that you are looking for a job. I could be wrong but that is what happened to me before.
