Property Asset CF Confusion! Please help!

When my parents divorced about 18 months ago it was decided in court that the family farm would be put into the names of the three sons, my oldest brother who has no CF, and the middle brother and myself both with CF.
The problem we are hitting is that my brother and I can't show the property as an asset or else we lose our insurance... and neither of us can possibly afford 5grand a month each in meds.... We thought about putting the property into the oldest brothers name and making the younger two the sole beneficiaries, but my middle brother doesn't trust the oldest brother (when it comes to decisions about the property) and my oldest brother feels the same about the middle brother.

What do we do?! I need legal advice... The first lawyer kept dragging his feet and we finally got a new lawyer (who's son actually has CF) and after he looked into it deeply he said he couldn't find a way to make it happen... But he would keep thinking on it.

So now we're reaching to any source who can help... Please, if anybody has any suggestions, they would be GREATLY appreciated!!



(P.S. On a separate subject; if anybody is still waiting for me to get back to them about the extra CF mats/equipment I was giving away... I'm really sorry, I've been out of town the past few weeks and just haven't been able to do anything about it yet, I didn't forget about you!)

Have you thought about putting it under your mother? do you have any aunts or uncles or any other family members that would do it for you that you trust?

i dont have any other suggestions other than that. maybe if you trust your older brother you could put yours under his name & your brother could maybe find another family mbr.

There is a thing called a Special Needs Trust that we are looking into for my son - he has cf and cerebral palsy and we are trying to protect any inheritance we would give him and allow him to still get Medicaid/Medicare later in life. Basically it sets aside certain assets in a trust so that it is not able to be counted as one of your assets. We went to a lawyers who specializes in Special Needs Trusts because they are very hard to put together correctly so the typical lawyer may not be able to do it so that it is water-tight. From what I understand the big problem with having the land in your brother's name is that if he were to divorce it could be part of the divorce settlement and you can't do anything about it because it's not in your name. I'm running out the door right now, but I'll see if I can find a link for you on it.
